Bryan Taylor, Canyon County Prosecutor, announced today that Roy D. Rico, age 38, of Caldwell, was sentenced by the Honorable Thomas W. Whitney for the felony crime of Driving Under the Influence. The charge was Rico’s fourth felony DUI and sixth lifetime DUI.
During the sentencing arguments, the prosecution asked for a life sentence (10 years fixed plus life indeterminate) arguing that the only way to protect the community from Mr. Rico was to incarcerate him as he is a serial DUI offender.
Judge Whitney, however, sentenced Rico to 6 years fixed, followed by 24 years indeterminate, for a total unified sentence of 30 years in prison. Judge Whitney also ordered Rico to pay court costs and reimbursement costs to his public defender.
Rico was arrested by Caldwell Police in November 2017 after he ran a stop sign at Homedale Rd. and Montana Rd. and nearly struck a car with a father and his three teenage children inside. When the officer arrived on scene, Rico attempted to flee the vehicle by jumping out of the passenger side door and running towards a nearby house. After detaining Rico, the officer noticed that Rico had difficulty walking, slurred speech, and smelled like alcohol. The officer also located an open bottle of beer on the floor of Rico’s vehicle. The officer attempted to do a field sobrietyand a breathalyzer , but Rico refused both. A warrant was obtained for a blood draw, which showed Rico had a blood alcohol content of .255. Rico was on probation at the time of his arrest for a prior felony DUI conviction in 2015. A blood draw taken in the 2015 DUI showed Rico had a blood alcohol content of .317 at the time of his arrest. Rico also had felony DUI convictions in 2011 and 2004, as well as misdemeanor DUI convictions in 2002 and 2001.
“Impaired driving a significant risk to public safety that can often have a ripple effect across the community,” said Deputy Prosecutor Ingrid Batey. “Mr. Rico is extremely lucky he hasn’t hurt or killed someone over the years. There is no doubt that he belongs in prison for an extensive period of time.”
